These Terms of Service ("Terms") govern your access to and use of thecallibercompany.com (the "Site"), operated by LOCT SOLUTION LLC, doing business as The Caliber Company ("we," "us," "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use this Site or place an order. By using the Site, you represent and warrant that you meet these requirements. Orders may not be placed on behalf of a minor.

2. Products, Descriptions, and Authenticity

We make every effort to display our products, including colors, materials, and details, as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Site are entirely accurate, complete, or error-free. All timepieces sold by The Caliber Company are represented as authentic. If you have reason to believe otherwise, please contact us immediately at office@thecallibercompany.com.

3. Pricing and Availability

All prices are listed in U.S. Dollars (USD) unless otherwise stated and are subject to change without notice. We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability. In the event of a pricing error, we will notify you before processing the order and give you the option to proceed at the correct price or cancel.

4. Orders and Payment

By placing an order, you represent that all information provided is accurate and that you are authorized to use the payment method submitted. We reserve the right to refuse or cancel any order at our sole discretion, including for reasons related to product availability, errors in pricing or product information, or suspected fraudulent activity. Payments are processed securely through Shopify Payments and/or other third-party payment processors integrated with our Site.

5. Shipping and Delivery

Standard delivery time is 8 to 21 business days from order confirmation, depending on destination and product availability. Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, or events beyond our reasonable control. Risk of loss and title for products purchased pass to you upon our delivery to the carrier.

6. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Please review it carefully before making a purchase.

7. Account Registration

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, product photography, and software, is the property of LOCT SOLUTION LLC / The Caliber Company or its licensors and is protected by U.S. and international intellectual property laws. THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR PRODUCT WARRANTY TERMS OR AS REQUIRED BY APPLICABLE LAW. Manufacturer warranties, where applicable, are provided directly by the respective manufacturer and are subject to their own terms and conditions.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LOCT SOLUTION LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless LOCT SOLUTION LLC, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration administered in accordance with the rules of a recognized arbitration organization, rather than in court, except that either party may bring an individual claim in small claims court. You and The Caliber Company each waive the right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-law principles.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
